Trust

Trusts are created when a person (settlor) transfers assets to a trustee, who holds and manages the assets for the benefit of the beneficiaries. The trustee has a legal obligation to manage the trust assets in the best interest of the beneficiaries and according to the terms of the trust deed.

Trusts are typically set up under a trust deed, which outlines the terms and conditions of the trust, including the rights and obligations of the trustee and beneficiaries. The trust deed also specifies how the trust assets should be managed and distributed to the beneficiaries.

Trust law originates from Common law (England) and generally holds a stronger foothold in Common law jurisdictions.

 

Private Foundation

Private Foundations are created when a person (founder) transfers assets to a legal entity that holds and manages the assets for the benefit of the beneficiaries. They are managed by a board of directors or council, who are responsible for carrying out the foundation’s objectives.

Foundations are established under a charter or articles of association which define the foundation’s objectives, governance structure, and operational guidelines.

Foundation law originates from Civil law (Europe) and generally holds a stronger foothold in Civil law jurisdictions.
